Holyoke Tire and Auto ServiceS REFERS TO INDEPENDENT INSTALLERS FOR THE INSTALLATION OF TIRES. Holyoke Tire and Auto Service IS NOT LIABLE FOR ANY DAMAGES THAT OCCUR FROM THE IMPROPER INSTALLATION OF TIRES, OR ANY DAMAGES THAT OCCUR ON THE INSTALLERS PROPERTY. Holyoke Tire and Auto Service HAS NO LIABILITY FOR ANY SERVICES PROVIDED BY THE INDEPENDENT INSTALLERS IT REFERS CLIENTS TO, NOR DO WE DIRECTLY ENDORSE SUCH INSTALLERS. ANY CLAIMS RESULTING FRO INSTALLATION ARE THE SOLE LIABILITY OF THE INSTALLER AND Holyoke Tire and Auto Service IS NOT LIABLE FOR ANY DAMAGES DUE TO THE INSTALLER OR ITS EMPLOYEES. Holyoke Tire and Auto Service IS ALSO NOT RESPONSIBLE FOR ANY CLAIMS IF TIRES ARE SELF-INSTALLED.

9. INDEMNIFICATION
User agrees to defend, indemnify and otherwise hold harmless Holyoke Tire and Auto Service and its officers, directors, agents, employees and assigns from and against any cause of action or claim, including legal fees, related to User’s use of the site.

10. SECURITY

12. TERMINATION OF AGREEMENT
Either Holyoke Tire and Auto Service or User may terminate this Agreement at its discretion. In addition to Holyoke Tire and Auto Service’s other rights, Holyoke Tire and Auto Service may terminate access to this site or cancel membership to any service that Holyoke Tire and Auto Service provides on the site, if User breaches this Agreement in any way or engages in conduct that Holyoke Tire and Auto Service deems inappropriate. In the event of termination of this Agreement, the provisions in this paragraph and the provisions found in paragraphs 4, 5, 6, 7, 8, 9 and 11 shall survive.

13. LINKS
User is granted a limited, revocable, and nonexclusive right to create a hyperlink to the home page of the site so long as the link does not portray Holyoke Tire and Auto Service or its products or services in a false, misleading, derogatory, or otherwise offensive matter. User may not use any Holyoke Tire and Auto Service logo or other proprietary graphic or trademark as part of the link without express written permission. 15. POLICIES
Pricing
Despite our best efforts, a small number of tires may be mispriced. If we discover this, we will, at our discretion, either contact you for instructions or cancel your order and notify you of such cancellation.

Out of Stock
Occasionally Holyoke Tire and Auto Service may be temporarily out of stock on a certain tire. In that case we will either contact you to re-schedule your installation, or cancel your order and notify you of such cancellation.

Tread Warranty
The tires sold by Holyoke Tire and Auto Service are warranted by the manufacturer of the tire. If you think your tire is eligible for replacement under the manufacturer’s warranty, you can take that tire to any dealer that carries your brand. Moreover, we will be happy to assist in obtaining fulfillment of a manufacturer’s warranty.

16. MISCELLANEOUS
These Terms of Use constitute the entire agreement between Holyoke Tire and Auto Service and User regarding the subject matter hereof. Any previous agreement, whether oral or written, between Holyoke Tire and Auto Service and User dealing with the subject matter hereof is superseded. If any portion of this Agreement is found to be unenforceable for any reason, such portion will be deemed severed and will not affect the enforceability of the remaining terms. Upon User’s breach of this Agreement, Holyoke Tire and Auto Service may pursue any legal or equitable remedy available, including but not limited to, direct, consequential and punitive damages and injunctive relief. Holyoke Tire and Auto Service’s remedies are cumulative and not exclusive. Failure of Holyoke Tire and Auto Service to exercise any remedy or enforce any portion of this Agreement at any time shall not operate as a waiver of any remedy or of the right to enforce any portion of the Agreement at any time thereafter. User agrees that regardless of any statute or law to the contrary, any claim or action arising out of or regarding this Agreement must be filed within one (1) year after such claim or cause of action arose or be forever barred. Holyoke Tire and Auto Service makes no representation that the content of the site is appropriate or available for use in all locations. Users of this site are responsible for compliance with all applicable local laws.
